RENTAL TERMS HANKØBOAT

HANKO BOAT (SELLER)
(org no 927 425 572), operates an online rental service where companies and consumers can rent boats with accessories by ordering and paying for the equipment online. The terms apply to the rental and sale of goods and services from  www.hankøbåt.no   to businesses and consumers. The terms and conditions, together with your order, will constitute a general agreement for the purchase.

RENTAL PERIOD, DELIVERY AND RETURN
The duration of the agreement (the "Rental Period") shall be from the Rental Time to the Return Time as stated above. The Boat Owner must, at the time of Rental, hand over the Boat to the Hirer at the handover location as stated above and the Hirer must, at the Return Time, return the Boat to the Boat Owner at the same location, unless otherwise agreed in writing. Both parties have a mutual duty to notify and wait for 30 minutes in the event of a delay. If, due to weather conditions, it is not or will not be reasonable to hand over/return the Boat as agreed, the party who is to hand over/return as soon as possible and at the latest one hour before the agreed time contact the other party to agree a new Rental or Return time. New Rental or Return time must be agreed as soon as the weather conditions make it reasonable.  If the Tenant does not show up at the agreed Rental Time, the Rental Period begins to run. If the Tenant does not show up for more than one day, when the rental period is over a week and this happens without him/her giving any notice to the landlord, the tenancy is terminated. In such cases, the tenant must still pay full rent for the first full week. For later rental weeks, the rental price must be reduced corresponding to the replacement rental achieved. If the tenant does not show up at the agreed return time, a fee for non-return will be charged in accordance with the current daily rent per product at any time. In the event of non-attendance at the agreed return time, the rental period continues to run according to the other terms of the agreement until the boat is returned to the lessor. In such cases, the Hirer is responsible for returning the Boat to the location specified by the Boat Owner. The hirer is responsible for all expenses, costs and losses incurred by the boat owner if the boat is not returned by the agreed return time.

PAYMENT, DEPOSIT AND PRICES
Payment is made via Visa or Mastercard online via our payment method DIBS, which meets the strictest security requirements. The tenant pays when ordering and then the rental agreement is deemed to have been entered into. The tenant must use our website for payment of the service unless another approved payment solution is agreed. If it is not possible to extend the Rental Period (for example because the boat has been rented out or because the Renter does not have the opportunity to use it) the rental price must be shortened. In the event of deferred handover due to conditions attributable to the Boat Owner or conditions for which the Boat Owner is at risk, the Hirer may request that the Rental Period be extended corresponding to the postponement or that the Rental Price be shortened corresponding to the postponement. If it is not possible to extend the Rental Period (for example because the boat has been rented out or because the tenant does not have the opportunity to use it), the Rental Price must be reduced corresponding to the postponement. Hankøbåt follows normal rental practices and also reserves a deposit amount as stated on the order receipt when ordering.  Reservation ensures if the customer returns the equipment late, damages the equipment or does not deliver at all. The size of the deposit varies with the selected equipment that is rented and appears in your order confirmation. Hankøbåt has the right to use the deposit to cover rent as well as other costs mentioned above and/or any recourse claims, cf. point 5 below. All prices include VAT. The total cost of the purchase will appear before ordering and will include all expenses associated with rental or purchase. Excluded from the total cost are expenses for fuel, which for the tenant are ongoing according to consumption. If there has been a significant error with the prices on Hankøbåt's side on the website, Hankøbåt can unilaterally change, delete or reject orders even after the customer has received order confirmation or the like. However, such errors must be corrected and the customer informed within a reasonable time after the error has been discovered.

SPECIAL AGREEMENT ON TRANSPORT 

If the parties have agreed delivery and/or return to  desired address and time  prepaid on our website, this must be agreed in writing with_cc781905-5cde-3194-bb3b-136_bad5cf58d_købåt info@han .no  before departure for carrier.

CONDITION OF THE BOAT AT HANDOVER AND LESSOR'S OBLIGATIONS 
Upon handover, the boat must be in contractual condition, cleaned and have a full fuel tank. If there are conditions   during handover with the boat/equipment that the hirer believes he may be charged for after the end of the hire, this must be taken up with the lessor on the same day that the hire starts. It must be documented with photos that are either sent by SMS or email on the same day. If the Boat is not ready for handover at the agreed time due to conditions on the Boat Owner's side, the rental shall be reduced by one day's rental for each day it begins. If the delay is more than one day in the case of up to one week's rent, or more than two days in the case of more than one week's rent, the Tenant can choose whether he wants to maintain or withdraw from the agreement. If the Boat is not in contractual condition, the Hirer can demand a reduction in the rental price. If the deficiency is of a serious nature, the Tenant may choose to withdraw from the agreement. If the Boat cannot be used for part of the Rental Period, and this is due to circumstances for which the Boat Owner is responsible, the rental shall be shortened proportionately. If the interruption is prolonged, the Tenant can withdraw from the agreement if the purpose of the tenancy is significantly changed.

DEFECT IN THE PRODUCT - BUYER'S RIGHTS AND COMPLAINT PERIOD

If there is a defect in the goods, the buyer must, within a reasonable time after it was discovered or should have been discovered, notify the seller that he or she wants to claim the defect. The buyer has always complained in sufficient time if it happens within 2 months. from the time the defect was discovered or should have been discovered. Complaints can be made no later than two years after the buyer took over the item. If the product or parts of it are intended to last significantly longer than two years, the complaint deadline is five years. In the event of a complaint, the customer should contact Hankøbåt at info@hankøbåt.no.

CONDITION OF THE BOAT ON RETURN, DAMAGES AND LESSEE'S OBLIGATIONS
On return, the boat must be in the same condition as on handover, cleaned and have a full fuel tank, unless otherwise agreed. If the boat is not satisfactorily cleaned or fully refueled upon return, the hirer will be charged for washed rented equipment (NOK 800 per hour incl. VAT), and/or a fee for filling up with fuel (NOK 400 incl. VAT) as well as the pump price for missing fuel. The Hirer is responsible for theft and any damage or defects to the Boat, including the Boat's engine and equipment, other damage or liability for damages incurred, incurred or arising as a result of the Hirer's use of the Boat. The Renter is financially responsible for expenses incurred by the Boat Owner in connection with cleaning, repairs and transport due to internal and external damage and/or damage caused to the Boat during the rental period. The boat is insured, in the event of theft or damage/liability that is fully or partially covered by insurance, the reserved deposit accepted by the tenant at the conclusion of the agreement is used. If problems of any kind arise with the Boat during the rental period, the Renter must immediately notify Hankøbåt of the incident. In the event of non-significant damage, the Lessee is obliged to follow Hankøbåt's instructions. 

REQUIREMENTS FOR LESSEES AND DRIVER(S) OF THE BOAT
It is the Lessee's responsibility to make sure that they are familiar with the area they will be traveling in and that all passengers have the correct size flotation devices according to regulations. It is the Hirer's responsibility to ensure that he or she has sufficient competence to operate all aspects of operating a boat. The Hirer confirms that all drivers of the Boat during the Rental Period have sufficient knowledge and any certificates/evidence required to drive the Boat. The hirer is responsible for making all drivers of the Boat aware of the terms of this agreement in advance. If the Hirer has given incorrect information about his own or other drivers' qualifications and skills, or if it is considered by others to be clearly unjustified to hand over the vessel, the Boat Owner has the right to terminate the agreement with immediate effect. When mooring the boat, the lessee or driver of the boat is obliged to ensure that the boat is properly secured on a wharf/mooring place where this has been clarified with the owner of the facility/place. Likewise, the lessee or driver of the boat must ensure that the boat is securely closed and locked. 

LESSEE'S MAINTENANCE OBLIGATION
During the rental period, the lessee must ensure that the Boat is maintained. Minimal maintenance is required. There is no need for maintenance other than regular boat washing and a visual inspection of the engine and boat to check if anything is damaged or loose.

LESSEE'S RIGHTS AND OBLIGATIONS 
The tenant must be 18 years of age and must provide correct customer details when creating a user account in order to order and rent at Hankøbåt. Hankøbåt sends messages to the specified e-mail, address and telephone and such messages are considered received and valid when sent by us. The user account is personal and if you suspect that others have access to your account, you must notify Hankøbåt  immediately. Hankøbåt has the right to freely reject, terminate or suspend a user account without warning or liability, including if the terms are deemed to have been breached. Furthermore, these rental terms must be accepted before ordering on the website. The tenant or cardholder authorizes Hankøbåt  to store credit card instructions for, among other things, rental objects that are not returned, are dirty beyond normal or in the event of damage to the rental object. The authorization thus granted also applies to the authorization to charge the payment card for additional rent/claims for compensation if the rental object is returned after the end of the agreed rental period or is returned with errors or defects.

RESTRICTION ON USE OF THE BOAT AND SPECIAL PROVISIONS 
The boat can only be used in Norway. The boat must not be used to tow paragliders and similar equipment. The boat may also not be used for towing tasks, salvage of other boats, (except in emergency situations), transport tasks where the hirer charges for the task, rental or other commercial purposes. This point does not prevent the boat from being used for towing smaller water toys such as inflatable sausages, rings, water skis etc. 

RIGHT OF WITHDRAWAL ON PURCHASE 
The Right of Cancellation Act gives you the right to cancel your purchases. The right of withdrawal applies to goods that have been purchased and not to rented objects. The right of withdrawal requires that you notify us of this no later than 14 days after you receive the delivery (See right of withdrawal  https://lovdata.no/dokument/NL/lov/2014-06-20-27_cc781905 -5cde-3194-bb3b-136bad5cf58d_ ). To use the right of withdrawal, the product must be delivered to us in approximately the same quantity and condition as you received it. If you try, use or examine the item (opening the packaging etc) in a way that goes beyond what is necessary to determine the nature, properties and function of the item and this results in the item being reduced in value, we can deduct an amount corresponding to the reduction in value in the purchase price to be refunded. The product is sent back to us in the original packaging and within a reasonable time, together with a right of withdrawal form. The easiest way is to return the item in the same box as when you return the rental object. Then there are no costs for you. Fill in the right of withdrawal form and put it in the box. If you choose to send it back by post or other methods, it is your responsibility until the item has reached us. You must provide your own, suitable packaging and contact us before sending.

CANCELLATION
The Lessee can cancel the lease against payment of a compensation to the Boat Owner according to the following model: In case of cancellation between 5 days and 14 days before the start of the Rental Period, 50% of the Rental Price is paid. In case of cancellation less than 5 days before the Rental Period starts, 100% of the Rental Price is paid. If the Boat Owner rents out the Boat during the rental period, the compensation must be reduced so that what the lessor receives must be deducted from the agreed rent. Nevertheless, the tenant must always pay 30% of the rental amount.

TERMINATION OF "FIXED PAYMENTS"  

The tenancy cannot be terminated during the binding period of 6 months (01 May to 31 October).

The tenancy is automatically terminated without notice after the specified lock-in period has ended.

LIABILITY OF THE PARTIES
The hirer is aware that the hire contract has been entered into by the Boat Owner or his representative. The boat owner is not responsible for the Lessee's or other passengers' medical condition, or the consequences thereof. The renter holds full responsibility for himself and his passengers.

AMENDMENTS, WRITING REQUIREMENTS
Additions to and changes to the rental terms in this agreement are binding only if they are contained in a written agreement, and are published on our website:  hankøbåt.no .

INTELLECTUAL RIGHTS
The content and the service are protected by the Copyright Act. Image material stored on the page has been obtained with permission from the rights holders. Videos on youtube are links to third-party services outside  Hankøbåt's control. 

PRIVACY 
Hankøbåt processes your personal information in a secure data register in order to fulfill its obligations and safeguard its rights in accordance with the lease agreement. The personal data processed are name, address, telephone number, e-mail address and order history. This history will remain stored for accounting and other obligations.  All saved information is available in "My Account". The tenant has the right to have their personal data removed from the Lessor's systems, which is done by contacting Hankøbåt in person. Your payment card will be stored as long as you have an active order. The payment card is stored at our payment intermediary DIBS. They store the information in a safe and secure manner. Saving payment cards makes it even easier when shopping. You can delete payment cards on your page. Hankøbåt does not store any credit card details itself. Hankøbåt uses cookies, like most other online stores. Cookies store data in your browser so that the website can recognize you from page to page and visit to visit. We can then recognize who you are so that, among other things, you can get the correct prices and easier login. We also collect usage information to improve the quality of the service. You will find more detailed information about our practices related to privacy by accessing the help page's submenu. There you will find privacy as a separate orientation.

Hankøbåt reserves the right to change or replace these terms and conditions at any time. Current terms and conditions are always available at hankøbåt.no . If Lei Enkelt considers that the changes in the terms and conditions are significant in relation to the lessee's rights or obligations, the changes will be made available at hankøbåt.no  30 days before they come into effect. By using the service after the changes to the terms have been made available at  hankøbåt .no   you agree to be bound by the updated terms. If you do not wish to accept those terms, you cannot use Hankøbåt.

DISPUTES
Any dispute between the parties must be resolved amicably. If negotiations do not lead, the parties have adopted the Sandnes district court as the court of jurisdiction in any case.
